Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the Footprinx™ mobile application ("App") operated by Danxu Wang ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By accessing or using the Footprinx™ App, you confirm that:

  • You are at least 13 years of age
  • You have read, understood, and agree to these Terms
  • You agree to our Privacy Policy, which is incorporated into these Terms

2. User Accounts

2.1 Registration

To use certain features of the App, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials, all activity that occurs under your account, and notifying us immediately of any unauthorized use.

2.2 Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, provide false or misleading information, or engage in fraudulent or illegal activity. You may delete your account at any time through the App's settings.

3. OTP / SMS Authentication

3.1 Phone Number Verification & SMS Consent

The App uses One-Time Password (OTP) authentication via SMS to verify your identity. By entering your phone number and submitting the registration or login form, you expressly consent to receive SMS messages from Footprinx™ for authentication purposes. You confirm the phone number belongs to you and that you are authorized to consent to receive SMS on that number.

Message frequency: 1 message per authentication request.

Msg & data rates may apply.

To opt out: Reply STOP to any SMS. You will receive a confirmation and no further messages will be sent. Note that opting out will disable SMS-based login; contact us to arrange an alternative.

Carriers are not liable for delayed or undelivered messages.

3.2 OTP Usage

OTP codes are valid for a limited time and for single use only. You must not share your OTP with any other person, use OTP codes received by another person, or attempt to bypass the OTP verification process.

3.3 Number Changes

If you change your phone number, you are responsible for updating it in the App immediately. We are not responsible for SMS messages sent to an outdated number.

3.4 SMS Provider

SMS messages are delivered via Twilio Inc. Your phone number is shared with Twilio solely for the purpose of delivering authentication messages. We do not use your phone number for marketing or promotional SMS.

4. Location Services

4.1 Location Permission

The App may request access to your device's location to provide location-based features. Granting location permission is optional; however, certain features may not function without it.

4.2 Your Control

You may enable or disable location access at any time through your device's settings. We will not collect location data without your permission.

4.3 Use of Location Data

We use your location data solely to provide the features of the App. We do not sell, share, or use your location data for advertising purposes. Please refer to our Privacy Policy for full details.

5. Acceptable Use

You agree to use the App only for lawful purposes. You must NOT upload, share, or otherwise transmit content that:

  • Sexually exploits or abuses minors, or depicts a minor in a sexually suggestive manner (this is reported to NCMEC as required by U.S. law — see Section 6)
  • Contains sexually explicit material, nudity, or pornography
  • Depicts graphic violence, gore, threats of violence, or incitement to violence
  • Contains hate speech, slurs, or harassment targeting protected groups (race, ethnicity, religion, national origin, gender, sexual orientation, disability)
  • Promotes or facilitates illegal activity
  • Impersonates another person or entity, or otherwise misrepresents the source of the content
  • Infringes another person's intellectual property, privacy, or publicity rights
  • Contains spam, mass-promotional links, or attempts to defraud other users
  • Contains malware, viruses, or any code designed to disrupt or compromise systems

To curb spam and scams, comments may not contain links of any kind (URLs, web addresses, or domain names). Comments containing links are blocked automatically when you try to post them.

You also agree not to:

  • Attempt to gain unauthorized access to any part of the App or its systems
  • Reverse-engineer, decompile, or disassemble the App
  • Use automated scripts or bots to access the App
  • Circumvent our content moderation systems
  • Violate any applicable local, state, national, or international laws

6. Content Moderation, Review, and Reporting

6.1 Pre-publish Automated Review

Any guide, journal, or place you choose to share publicly or via an invite link goes through automated content review before it becomes visible to anyone other than you. Review uses third-party machine-learning classifiers (Hive Moderation for images and video, OpenAI Moderation for text) and typically completes in seconds. While review is running, your content is visible only to you.

6.1a Comment Moderation

Comments work differently from the pre-publish review above: a comment is published immediately and then scanned automatically within seconds by a third-party machine-learning classifier (OpenAI). A comment found to contain links or content that violates Section 5 is removed and shown to others as a “[comment removed]” placeholder; any replies to it remain visible. You can delete your own comments at any time.

6.2 Possible Outcomes

  • Approved — your content can be listed in Explore or shared via an invite link, your choice.
  • Edit & resubmit — borderline content. You see the reason and can edit your content to address it, then resubmit for review.
  • Removed — content found in clear violation of Section 5. The content stays in your account but cannot be shared.

6.3 Appeals

If your content is removed for a non-severe violation (e.g., a borderline image of violence or hate speech), you can submit an appeal from within the App. An admin will review your appeal and either uphold the removal or restore your content. Appeals are NOT available for content classified as child sexual abuse material (CSAM). CSAM removals are final and reported to NCMEC as described in Section 6.5.

6.4 User Reports

You can report any public content you encounter from inside the App. Reports are reviewed by an admin, who may remove the content, ban the author, or dismiss the report. Reporting in good faith is encouraged; bad-faith or abusive reporting may result in account action.

6.5 Mandatory Reporting of CSAM

If our automated review or a user report identifies apparent child sexual abuse material on the App, we are required by 18 U.S.C. § 2258A to report it to the National Center for Missing & Exploited Children (NCMEC) CyberTipline. In such cases, we will preserve the offending content and associated metadata (the file, its cryptographic hash, the uploader's account information, and the upload timestamp) for at least 90 days, and longer if requested by NCMEC or law enforcement. We will not notify the offending user that a report has been filed, as doing so would violate § 2258A.

6.6 Account Action

Repeated violations of Section 5, attempts to evade moderation, or any upload of CSAM will result in suspension or termination of your account in addition to any content-level removals. We apply two layered limits:

  • Per-content limit. If our automated review flags the same piece of content three times in a row, that content is sent for human review and you cannot resubmit it without filing an appeal under Section 6.3. After three separate confirmed removals of the same content, the content is permanently locked from resubmission.
  • Account-wide limit. If five or more pieces of your content are removed by automated or human review within any rolling 180-day window, your ability to submit new content for review is paused. Existing approved content stays visible during the pause; only the ability to publish new content is affected. The pause automatically lifts as removals age past the 180-day window. We may extend or convert the pause into a full account termination for severe or repeated abuse.

CSAM removals (Section 6.5) always count toward both limits and may, at our sole discretion, result in immediate termination without notice and without the 180-day recovery window.

7. AI Features (AI Auto-Fill)

7.1 Opt-in feature

The App offers an optional “Describe in words” feature in the journal and guide builders, currently in BETA. When you actively choose to use this feature and submit a paragraph (typed or dictated), your input is sent to a third-party large language model (OpenAI, see Section 16) for structured extraction, and the resulting draft is pre-filled into the builder for your review.

You can submit input by typing or by tapping the microphone button to dictate. If you dictate, your audio is transmitted to OpenAI's Whisper API for speech-to-text transcription. The audio is processed and not retained — we only keep the resulting text transcript. Voice input requires microphone permission from your operating system; you can grant or revoke this in your device settings at any time.

The AI auto-fill feature is opt-in per use — nothing is sent to the LLM unless you actively tap Generate (or stop a voice recording, which sends the audio for transcription). The rest of the App functions without invoking AI. You can always type a draft manually.

7.2 No warranty as to accuracy

AI-generated drafts may be inaccurate, incomplete, out-of-date, or otherwise unsuitable for any particular purpose. In particular, location pins for businesses that have closed or that the underlying map provider does not have indexed may resolve to an admin region (e.g., a state or country centroid) rather than the actual location. The App marks such cases in the preview with a red warning and prompts you to adjust them on the map before saving.

You remain solely responsible for the accuracy of any content you save and publish, regardless of whether you drafted it manually or used AI auto-fill. We do not endorse, verify, or guarantee the correctness of any AI-generated draft. Do not rely on AI auto-fill output for safety-critical, legal, medical, financial, or other consequential decisions.

7.3 Acceptable use of AI features

You agree not to use the AI auto-fill feature to:

  • Generate content that violates Section 5 (Acceptable Use)
  • Attempt to extract, reverse-engineer, or probe the underlying LLM or its prompts
  • Submit content you do not have the right to disclose to a third-party processor
  • Submit content you would not want stored in our database (we log inputs — see the Privacy Policy, Section 6)
  • Abuse the rate limit (currently 20 requests per user per hour) or otherwise impose unreasonable load on the feature

7.4 Logging and improvement

We log your AI auto-fill input, the model's output, and the final draft you save (if any) to measure quality and improve the feature. See the Privacy Policy, Section 6, for the full data-handling description.

7.5 Availability

As a BETA feature, AI auto-fill may be modified, paused, or removed at any time without notice. We may also disable the feature for individual users who violate these Terms.

8. App Intellectual Property

The Footprinx™ App itself — including its name, logo, branding, software, code, design, text, and graphics created by us — is and remains the exclusive property of Danxu Wang. This Section 8 does not apply to content uploaded by you or other users; user-uploaded content is governed by Section 9.

You are granted a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the App itself without our prior written consent.

9. Your Content

8.1 You Own Your Content

You retain all ownership rights in the content you upload to the App — guides, journals, places, photos, videos, comments, descriptions, and tags ("Your Content"). We do not claim ownership of Your Content.

8.2 License You Grant Us

To operate the App, we need permission to store, process, display, and share Your Content with the audience you choose. You hereby grant Danxu Wang a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for technical purposes such as resizing or thumbnail generation), publish, display, and distribute Your Content solely to:

  • Operate, maintain, and improve the App.
  • Display Your Content back to you within the App.
  • Display Your Content to the audience you choose (Explore for public content; recipients of any invite links you generate for link-only content).
  • Submit Your Content to our content-moderation service providers (see Section 6.1).
  • Promote Footprinx™ in marketing and editorial materials, with attribution.

This license lasts as long as Your Content is on the App. When you delete a piece of content (or your entire account), the license terminates as to that content — except where retention is required by law or by our content-moderation retention rules (see the Privacy Policy Sections 4 and 5).

8.3 Your Representations

By uploading Your Content, you represent and warrant that:

  • You own Your Content or have obtained all necessary rights, licenses, and permissions to upload and share it.
  • Your Content does not infringe any third party's copyright, trademark, patent, trade-secret, privacy, publicity, or other right.
  • Your Content does not contain anything prohibited by Section 5.
  • You have the right to grant the license in Section 9.2.
  • Where Your Content depicts another identifiable person, you have obtained that person's consent to upload and share their likeness — including any minors' parent or legal guardian where applicable.

8.4 Responsibility for Your Content

You are solely responsible for Your Content and the consequences of uploading or sharing it. We do not endorse, verify, or take responsibility for the accuracy, quality, or legality of user-uploaded content. If a third party suffers loss or pursues a claim because of Your Content, that is on you, not on us — see Section 11 (Indemnification).

10. Public Sharing, Visibility & Redistribution

9.1 What Becomes Visible When

Content you create is private by default — only you can see it. Content is made visible to others only when you actively choose to: (a) list it in Explore for any authenticated user to discover, or (b) generate an invite link and share it with specific people. In both cases the content first passes through automated review (see Section 6.1).

9.2 No Expectation of Privacy in Shared Content

Once you share content — publicly or via an invite link — you should expect that people who can see it may also:

  • Take screenshots or screen recordings.
  • Save copies locally on their device or in third-party apps.
  • Share or re-post your content elsewhere on the internet.
  • Quote, summarize, or describe your content in third-party contexts.

We cannot prevent, detect, or undo any of these actions. We do not control the operating system, web browser, screenshot tool, screen recorder, camera, or messaging app of any viewer. If you choose to share content, you accept that copies of that content may exist outside our control and may continue to exist even after you delete the original from the App.

9.3 Deleting or Taking Down Your Content

You can delete Your Content at any time (or take it down from Explore while keeping it on your account). When you do:

  • The content is removed from Explore, from invite-link recipients, and from any other in-App surface within a reasonable time.
  • Bookmarks, likes, and comments from other users may persist on your account in aggregate counts but are detached from the deleted content.
  • We cannot remove copies that other users have already saved, screenshotted, re-shared, or otherwise captured outside the App. You agree that taking down your content from the App is the full extent of our deletion obligation.
  • Retention rules in the Privacy Policy may keep certain copies on our infrastructure (e.g., backups, legally required preservation) for a limited period.

9.4 No Expectation of Indefinite Availability

We make no promise that any specific piece of content (yours or another user's) will remain available on the App indefinitely. Content may be removed by us, by you, by another user (their own content), or by automated moderation at any time.

11. Indemnification

You agree to indemnify, defend, and hold harmless Danxu Wang and any affiliates, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to: (a) Your Content, including any claim that Your Content infringes third-party rights or violates applicable law; (b) your use or misuse of the App; (c) your violation of these Terms; or (d) your violation of any third party's rights. We reserve the right to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of that claim.

12. Copyright Infringement Notices (DMCA)

We respect intellectual property rights. If you believe content on the App infringes your copyright, please send a written notice to [email protected] including:

  • Your physical or electronic signature.
  • Identification of the copyrighted work you believe has been infringed.
  • Identification of the allegedly infringing content (e.g., the in-App share URL).
  • Your contact information (name, address, email, phone).
  • A statement, under penalty of perjury, that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or law, and that the information in your notice is accurate.

We respond to valid DMCA notices by removing the allegedly infringing content. We may terminate the accounts of repeat infringers. If you believe content was removed in error, you may submit a counter-notice to the same address.

13. In-App Purchases and Payments

If the App offers in-app purchases or premium features, the following applies:

  • All purchases are processed through Apple App Store or Google Play
  • Payments are subject to the respective platform's billing terms
  • All sales are final unless required otherwise by applicable law
  • Subscription fees are billed in advance and are non-refundable except where required by law

14. Disclaimer of Warranties

The Footprinx™ App is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied. Use of the App is at your own risk.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Danxu Wang shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, business interruption, or personal injury arising out of your use of the App. Our total liability shall not exceed the amount you paid to us in the past 12 months (if any).

16. Third-Party Services

The App may integrate with or link to third-party services (e.g., SMS providers, map services, push notification relays such as Expo and Apple Push Notification service). We are not responsible for the content, privacy practices, or terms of any third-party services.

By enabling push notifications in the App, you consent to your device's push token being transmitted to and stored by Expo (our push relay) and to Apple Push Notification service for the purpose of delivering notifications about activity on your content (likes, saves, comments). You may disable notifications at any time in the App's Settings → Notification preferences, or revoke permission via iOS Settings → Notifications. We do not send marketing push notifications.

17. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

18. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately and we may delete your account and data in accordance with our Privacy Policy.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the United States.

20. Changes to Terms

We reserve the right to modify these Terms at any time. We will update the "Last Updated" date and notify you of material changes via email or in-app notification. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
